1. Acceptance of our Terms

By visiting the website www.pchaudio.co.uk, viewing, accessing or otherwise using any of the services or information created, collected, compiled or submitted by PCH AUDIO, you agree to be bound by the Terms and Conditions of Service stated below and elsewhere on our website. If you do not want to be bound by our Terms your only option is not to visit, view or otherwise use the services of PCH AUDIO. You understand, agree and acknowledge that these Terms constitute a legally binding agreement between you and PCH AUDIO and that your use of PCH AUDIO shall indicate your conclusive acceptance of this agreement.

2. Provision of Services

You agree and acknowledge that PCH AUDIO is entitled to modify, improve or discontinue any of its services at its sole discretion and without notice to you even if it may result in you being prevented from accessing any information contained in it. Furthermore, you agree and acknowledge that PCH AUDIO is entitled to provide services to you through subsidiaries or affiliated entities.

3. Proprietary Rights

You acknowledge and agree that PCH AUDIO may contain proprietary and confidential information including trademarks, service marks and patents protected by intellectual property laws and international intellectual property treaties. PCH AUDIO authorizes you to view and make a single copy of portions of its content for offline, personal, non-commercial use. Our content may not be sold, reproduced, or distributed without our explicit written permission. Any third-party trademarks, service marks and logos are the property of their respective owners. Any further rights not specifically granted herein are reserved.

4. Submitted Content

When you submit content to PCH AUDIO you simultaneously grant PCH AUDIO an irrevocable, worldwide, royalty free license to publish, display, modify, distribute and syndicate your content worldwide. You confirm and warrant that you have the required authority to grant the above license to PCH AUDIO.

5. Termination of Agreement

The Terms of this agreement will continue to apply in perpetuity until terminated by either party without notice at any time for any reason. Terms that are to continue in perpetuity shall be unaffected by the termination of this agreement.

6. Disclaimer of Warranties

You understand and agree that your use of PCH AUDIO is entirely at your own risk and that our services are provided "As Is" and "As Available". PCH AUDIO does not make any express or implied warranties, endorsements or representations whatsoever as to the operation of the PCH AUDIO website, information, content, materials, or products. This shall include, but not be limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement, and warranties that access to or use of the service will be uninterrupted or error-free or that defects in the service will be corrected.

7. Limitation of Liability

You understand and agree that PCH AUDIO and any of its subsidiaries or affiliates shall in no event be liable for any direct, indirect, incidental, consequential, or exemplary damages. This shall include, but not be limited to damages for loss of profits, business interruption, business reputation or goodwill, loss of programs or information or other intangible loss arising out of the use of or the inability to use the service, or information, or any permanent or temporary cessation of such service or access to information, or the deletion or corruption of any content or information, or the failure to store any content or information. The above limitation shall apply whether or not PCH AUDIO has been advised of or should have been aware of the possibility of such damages. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not allowed the liability of PCH AUDIO is limited to the greatest extent permitted by law.

8. External Content

PCH AUDIO may include hyperlinks to third-party content, advertising or websites. You acknowledge and agree that PCH AUDIO is not responsible for and does not endorse any advertising, products or resources available from such resources or websites.

9. Jurisdiction

You expressly understand and agree to submit to the personal and exclusive jurisdiction of the courts of the country, state, province or territory determined solely by PCH AUDIO to resolve any legal matter arising from this agreement or related to your use of PCH AUDIO.

If the court of law, having jurisdiction, rules that any provision of the agreement is invalid, then that provision will be removed from the Terms and the remaining Terms will continue to be valid.

10. Entire Agreement

You understand and agree that the above Terms constitute only a portion of the general agreement between you and PCH AUDIO, and some terms may be otherwise located on the website www.pchaudio.co.uk. You may be subject to additional Terms and conditions when you use, purchase or access other services, affiliate services or third-party content or material.

11. Changes to the Terms

PCH AUDIO reserves the right to modify these Terms from time to time at our sole discretion and without any notice. Changes to our Terms become effective on the date they are posted and your continued use of PCH AUDIO after any changes to Terms will signify your agreement to be bound by them.

12. Returns Policy

All of our products are thoroughly inspected and tested prior to being shipped and as such we will be very surprised if you are unhappy with any of our products.

We ask that you thoroughly check over the physical condition of the item upon delivery, as returns requests for physical defects will only be accepted within 3 days of receiept of delivery by the customer. For any loudspeaker, compression driver or electrical issues we will accept returns requests up to 7 days from receipt of delivery by the customer. Please note, we may ask for pictures to prove an issue exists.

If you are unhappy with your product outside of the laid out time constraints but feel you have a valid reason to request a return, please get in touch and we'll do our best to help you out - please note returns outside of the previously specified time frame are at our discretion.

Due to the nature of working with delicate speaker drivers with specific power handling tolerances, we unequivocally reserve the right to refuse a refund on any drivers we think have been damaged or 'blown' due to customer misuse. The final decision if such an issue arises is to be made by PCH AUDIO.

The process for a return / refund goes as follows:

• Customer contacts PCH AUDIO within the time frame specified requesting a refund.
• PCH AUDIO will reply and may request photographic evidence.
• Customers will organize postage / delivery of said item.
• Upon PCH AUDIO receiving delivery of the item and being satisfied that it's a genuine problem that hasn't been caused by customer misuse a full or partial refund or replacement will be issued. It is at our discretion to decide what constitutes a ‘genuine problem’.

If we decide that the loudspeaker has been damaged through customer misuse we will only issue a refund for the cabinet,

not the cost of the loudspeaker.

13. Cabinet refurbishment policy

• PCH Audio has the right to handle, use & interfere with your property.
• PCH Audio has the right to make changes to your property when undergoing repair work.
• PCH audio has the right to refuse repair work if goods are too far damaged.
• PCH Audio has the right to refuse the return of, and hold your property if invoices remain unpaid.
• PCH Audio has the right to take ownership of your property as collateral if invoices remain unpaid for 90 days after work completed.
• PCH Audio has the right to sell your property if invoices remain unpaid for 90 days after work completed.
• PCH Audio has the right to charge storage fees for customers property if invoices remain unpaid for 10 days after work completed.
• PCH Audio assumes NO responsibility for loss or damage to your property through theft or fire when left in our care.
• PCH Audio has the right to charge storage fees for customers property if work is paid for but goods left un-collected for 4+ weeks after work completed.

14. Shipping policy

We aim to ship our orders within a maximum of 6 weeks from work starting, NOT after the security deposit is paid.

Often clients are asked to pay the security deposit as early as possible, to secure a position on PCH AUDIO's work schedule and avoid further lead times. PCH AUDIO will individually notify clients of receiving a security deposit and starting to manufacture the agreed upon products.

Please remember that all of our products are made to order. We are unable to give clients a set ‘generic’ lead time as workloads may be high, and we do not always hold stock of all components. Thus lead times are often dictated by our secondary suppliers.

​We do however aim to give you our best estimate of the current lead time when we supply you with a quote.

This estimated lead time is in no way a binding or contractual time frame unless explicitly noted in writing by the director of PCH AUDIO.
